Terms of Service

1. Who we are
These Terms apply to use of the BTA Tutor Portal at thebtaonline.au (“the Service”), operated by Better Tuition Academy Pty Ltd (“BTA”, “we”, “us”), an Australian tutoring business with five campuses on Sydney's Northern Beaches and North Shore.
By using the Service you agree to these Terms. If you do not agree, do not use the Service.
2. Who can use the Service
- Parents and guardians aged 18 or over can create a family account
- Students under 18 can use the Service only through a family account created and consented to by their parent or guardian
- Tutors use the Service under their employment or contract with BTA
By creating a student account for a child, the parent/guardian represents that they have authority to do so and consent to the collection of the child's information described in our Privacy Policy.
3. Your account
- Keep your password confidential
- You are responsible for activity under your account
- Notify us promptly if you suspect unauthorised use
- One account per person; do not share login credentials
4. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose
- Upload content that is offensive, abusive, defamatory, or infringes anyone's rights
- Attempt to gain unauthorised access to other users' accounts or to the Service
- Use the Service in a way that could damage, disable, overburden, or impair it (this includes spamming the AI features with the intent to drive up our costs)
- Reverse engineer, decompile, or attempt to extract source code
- Use automated scraping or bots without our written permission
- Submit prompts to the AI features that attempt to extract other users' data or override the system's safety guidelines
5. Subscriptions and billing
Family access to the Service is subject to your active enrolment with BTA. Tutoring fees are billed separately under your enrolment agreement. Subscription payments through the Service are processed by Stripe; payment terms appear at the point of purchase.
If your enrolment lapses, your family's access may be paused (the portal may show a paywall) or terminated as set out in your enrolment agreement.
6. AI features
The Service includes AI-powered tools (study tutor chat, exam-prep planner, photo capture of timetables and exam notices). These tools:
- Are educational aids, not a substitute for human tutoring, professional advice, or qualified educator judgement
- May occasionally produce inaccurate or misleading responses; treat AI output as a starting point, not a final answer
- Process your inputs via Anthropic's Claude API. Anthropic does not train models on data submitted via the API
We may impose reasonable usage limits on the AI features to prevent abuse and control costs.
7. Your content
You retain ownership of content you upload (homework, notes, photos, etc). By uploading, you grant BTA a non-exclusive licence to store, display, and process that content for the purpose of providing the Service to you and your family.
Tutors' lesson notes are visible to the student and parent in the relevant family. Mail messages are visible to the sender and recipient. Friend connections only expose the minimal data described in our Privacy Policy.
8. Intellectual property
BTA-authored study materials (mini-courses, lessons, articles, widget content) are provided for the personal educational use of the enrolled family. Reproducing, sharing, or republishing this content outside the family is not permitted without our written consent.
The Service software, branding, and design are owned by BTA. These Terms do not transfer any of those rights to you.
9. Third-party services
The Service integrates with third-party providers (Supabase, Anthropic, Resend, Stripe, Teachworks, Vercel). Use of those services is subject to their own terms and privacy policies. We are not responsible for outages or errors caused by those third parties.
10. Disclaimer and limitation of liability
The Service is provided “as is”. To the maximum extent permitted by Australian law, BTA excludes all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Nothing in these Terms excludes or limits your statutory consumer guarantees under the Australian Consumer Law. If we breach a consumer guarantee, our liability is limited (where the law allows) to re-supplying the affected service or refunding the fees paid for it.
Subject to the above, BTA's aggregate liability arising out of or in connection with the Service in any twelve-month period is limited to the fees paid by you to BTA in that period.
11. Termination
You can stop using the Service at any time. You can request account deletion by emailing contact@thebta.au.
We may suspend or terminate your access if you breach these Terms, if your BTA enrolment ends, or if we are required to do so by law.
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced via email to the registered parent account. The “Last updated” date reflects the most recent revision.
13. Governing law
These Terms are governed by the laws of New South Wales, Australia. You and BTA submit to the exclusive jurisdiction of the courts of New South Wales for any dispute arising out of or in connection with the Service.
